Manslaughter, What The?

I will preface this with – I don’t know the full story with this but…..

Can someone explain to me why the 29 year old victim of a home invasion this morning is being charged with manslaughter?

The Courier Mail reported the story generally as follows.

Sources say the 29-year-old homeowner told police he arrived home about 1.40am to be confronted by four masked men inside the house.

He told police he wrestled with one of the intruders and the gun discharged, the bullet hitting the man’s femoral artery.

Bleeding profusely, the alleged home invader staggered outside and into the street where he dropped dead, leaving a 50m blood trail in his wake.

This afternoon, police charged the homeowner with manslaughter. He is expected to face Southport Magistrates Court tomorrow morning.

What the hell????

If the above is true and reads correctly then there is something seriously wrong with the laws in this country!!

Picture yourself in this situation. You arrive home very late at night early morning. Unlock the door to your house, walk in and find four people in your house stealing your shit. You try and make them leave your house and one of them pulls a gun on you, there is a struggle and the gun goes off wounding the man who has invaded your home. The four robbers leave and the robber who was shot shortly after dies from the injury caused during the struggle.

What else should he have done? Other than turn around, run out the door and call the police and hope they show up in the next couple of hours?

Frankly this is a bunch of crap, rules like this protect criminals and punish victims.

People may say the poor robber who died is a victim too but he is the one who decided to commit the first crime.

I understand that the homeowner may be known to Police and their are whispers of him being a druggy and/or dealer etc. I don’t care!! If you come home and there is someone in your house you should have the right to defend your home, property and life with any force available.

Lewis and Lockyer

Something very special happened this last week. 20 years after the great Wally Lewis celebrated his last Origin game and series victory over New South Wales two games to one the great Darren Lockyer completed the exact same accomplishment as Queensland Captain.

From 1991 on the left to 2011 on the right.

I am not sure if there are plans to erect a bronze statue in Lockyer’s honour at Lang Park but I don’t think such a discussion is unwarranted. He has impressed throughout his career as captain of Brisbane Broncos (who have Lang Park as their home ground), Captain of the Queensland State of Origin team and Captain of the Australian Kangaroos team. Hopefully his immortalisation in bronze will be considered as I believe both should stand together at the entrance of Lang Park.

I remember Wally Lewis’s last series as Origin Captain watching every game in a bean bag on the floor next to my fathers chair and loving every second of it…

In game one where Lewis found a gap made a break and managed to get the ball to big Mal for the only Qld try of the game and then watching big Mal put the conversion over and the Queenslander’s holding on for the win.

Then in game two we had the Mark Geyer incident in which Wally Lewis stood up to the NSW giant and tried to get him sucker him into a fight right in front of the ref and then the last ditch kick for goal from Michael O’Connor from the sideline as it pissed down to win the game for NSW.

Then game three when the fairytale was completed a back and fourth struggle where Mal Meninga, with sweat dripping from his nose managed to break the deadlock and get the 2 point lead. I later learned that Lewis had played the crowd perfectly. With Ten minutes before the end of the game the Lang Park ground announcer reminded the capacity crowd that Wally Lewis was playing his last game for Queensland. The Maroons supporters roared as they never had before to lift their weary gladiators to the line and Lewis to his ultimate victory and slow farewell lap around his home ground. Queensland manager Dick “Tosser” Turner later admitted that Lewis had given an instruction and plotted the perfect timing for the announcement to be made.

While the 2011 series did not have the away-from-the-ball excitement of the 1991 series perhaps, it was certainly an equal spectacle in its own right and fitting end to Lord Lockyer’s Origin career.

I have a sneaky suspicion the great man is not done yet and am gambling on a Lockyer lead NRL Grand Final appearance and victory for the Broncos capping of a legendary career in perfection.

UFC 132 Moment of the Night

Tito Ortiz chokes out Darth Bader!!!!!!!!!!

That was awesome alone but then I got to see something I had forgotten he does when he wins (to be fair it had been a while). Tito digs a grave, drags the corpse into the grave and covers the grave back up again. The most awesome celebration in sports entertainment. Even better I got to see it live. Here is a quick snapshot picture from the video I made of the event in which Tito is digging the grave.

You ok Bader? You alright mate? Off you go mate.

The other awesome thing is that our sponsors at Sportingbet.com offered juicy odds of 4.85 on Tito’s chances. I thought that was pretty reasonable and had a dip at it. Happy days for Tito and happy days for notasmartman.com

UFC 132 Weigh-Ins

I am in Vegas and partying on like it was 1999. Part of the trip is a planned visit to the UFC 132 event at the MGM Grand.

Today was the weigh-ins and I was able to take the following happy snaps.
